Cuyahoga County Board of Health — Intellectual Property Legal Notice

This Intellectual Property Legal Notice (the “Notice”) applies to the Cuyahoga County Board of Health (“CCBH”), including its FEED OUR FUTURE® initiative and the proprietary HARVEST OF THE MONTH℠ program model and content (collectively, “CCBH IP”). This Notice summarizes ownership, scope of rights, permitted use, and enforcement relating to CCBH IP. This Notice applies across all media and distribution channels, including without limitation websites, mobile applications, social media accounts and posts, newsletters, streaming platforms, podcasts, webinars, digital advertising, email marketing, SMS/MMS, printed materials, packaging, signage, event displays, and any other physical or digital marketing collateral now known or later developed.

Ownership and Scope of Rights

CCBH is the exclusive owner of all right, title, and interest in and to its original content, trademarks and service marks, trade dress, program models, designs, graphics, text, layouts, educational modules, recipes, kits, and other materials associated with FEED OUR FUTURE® and the HARVEST OF THE MONTH℠ program (the “Licensed Content”). The Licensed Content includes the selection, coordination, and arrangement of monthly themes, features, recipes, and educational content, as well as the underlying text, graphics, and layouts embodied in FEED OUR FUTURE® program kits and related materials. For clarity, the Licensed Content also includes digital assets and metadata such as webpages, page templates, user interface elements, icons, buttons, animations, video and audio content, captions, alt text, hashtags, social media posts and stories, downloadable PDFs, QR code‑linked materials, and email templates.

No rights are granted by implication, estoppel, or other theory for online republication, embedding, scraping, framing, mirroring, training of AI models, text/data mining, or other secondary use of CCBH IP without express prior written permission.

Trademarks and Service Marks

CCBH owns and uses the following marks in commerce in connection with its nutrition education programming and related materials:

Without limitation, CCBH owns common law trademark and service mark rights in the HARVEST OF THE MONTH℠ mark for nutrition education programming, educational materials, model features and themes, and related promotional items, as well as other educational resources, student‑facing activities, and featured recipes highlighting the designated produce item. Through continuous, substantially exclusive, and geographically broad use in Ohio since at least September 2016, including use across public-facing materials, events, newsletters, school programming, web and social content, and licensed third-party implementations, the HARVEST OF THE MONTH℠ mark has acquired protectable goodwill and source-identifying significance.

All trademarks, service marks, logos, trade dress, and brand elements of CCBH may not be used in any manner that is likely to cause confusion or to suggest sponsorship, endorsement, or affiliation without CCBH’s prior written permission.

Copyright

All original content within the Licensed Content and program kits, including text, graphics, illustrations, designs, photos, layouts, lesson plans, recipes, and the curated selection, coordination, and arrangement of monthly themes and educational materials, is protected by U.S. and international copyright laws. All rights not expressly granted are reserved. Unauthorized reproduction, distribution, adaptation, public display, public performance, or derivative use of the Licensed Content is prohibited. This prohibition includes copying or reposting website pages, blog posts, downloadable resources, and social media content (including photos, videos, captions, and stories), as well as printing or distributing physical copies of any materials without permission. Linking to CCBH content is permitted if the link is functional, resolves to the full, unaltered page, and does not frame, inline link, or otherwise display CCBH content within a third‑party site or application.

Licensing and Authorized Use

CCBH has licensed its HARVEST OF THE MONTH℠ program model and Licensed Content to schools, school districts, and organizations throughout Ohio under written license agreements and term sheets. Any use, adaptation, distribution, or implementation of the Licensed Content or CCBH marks requires a valid, signed written license from CCBH or its authorized designee. Absent such permission, use is strictly prohibited and may constitute infringement, unfair competition, dilution, misappropriation, or other violations of law.

Licensees must comply with all applicable usage, attribution, quality control, and brand guidelines, including proper use of CCBH’s marks and notices, and must not modify, obscure, or remove copyright, trademark, service mark or other proprietary notices.

Licensees may publish approved content on their websites, learning management systems, and social media channels only in the formats, territories, and timeframes authorized by CCBH, and must include required attribution and links/notices as specified by CCBH. Printing or producing physical collateral (e.g., posters, flyers, banners, kits, handouts, stickers, apparel) must follow CCBH’s print specifications, color standards, size and placement rules for marks, and proof approval processes.

Licensing, Permissions, and Collaborations

For licensing inquiries, collaboration proposals, press, or requests for permission to use CCBH intellectual property, contact CCBH at the address or email designated by the Cuyahoga County Board of Health for FEED OUR FUTURE®. Any permission must be in a signed writing from an authorized representative of the Cuyahoga County Board of Health to be valid.

Monitoring and Enforcement

CCBH diligently monitors and enforces its rights. CCBH reserves all legal and equitable remedies, including injunctive relief, damages, statutory damages, impoundment, attorneys’ fees, and costs, as available under applicable law.

Reservation of Rights; No Waiver

All rights are expressly reserved. No failure or delay by CCBH in exercising any right or remedy shall constitute a waiver thereof. This Notice is subject to change without notice.

No Affiliation; Limited Reference Use

Use of CCBH’s marks in purely informational, nominative references (for example, to truthfully identify CCBH as the source of a program in news reporting or academic commentary) must be accurate and not misleading, must not alter the marks, and must not imply sponsorship, partnership, or endorsement. CCBH’s marks and content may not be used in a manner that is confusingly similar to, or that trades on the goodwill of, CCBH’s brands. Nominative fair use does not permit copying or displaying CCBH’s logos or distinctive trade dress, nor the reproduction of proprietary program content or templates on websites, social media, or electronic/printed materials.

Where space and format permit, users authorized by CCBH should include appropriate notices, including: FEED OUR FUTURE®; HARVEST OF THE MONTH℠; and any other applicable CCBH marks, along with the following:  © Cuyahoga County Board of Health.
